Subject : Instructions regarding implementation of the Hon’ble CAT, Delhi order dated 5/07/2022 in OA No.2691/2021 in the matter of Sh. Bhanwar Lal Rawal & Ors. Vs. Uol & Ors. regarding settlement of pension cases.
The undersigned is directed to refer to the subject cited above and to forward herewith instructions issued by the Ministry of I&B vide letter No.V-11013/07/2021-BAE dated 6/10/2022, which have been issued in supersession of their carlier letter No.V-11013/07/2018-BAE dated 18/08/2021 and has been endorsed by CCA, MIB vide OM No.G-11502/Pr.AO/I&B/CourtCase/2022-23/1018 dated 7/10/2022 and O/o the ADG(B&A), Prasar Bharati OM No. PB-7(7)/2021-22/Admn/152 dated 17/10/2022, containing instructions regarding settlement of pension cases during the pendency of WP No. 9890/2019.
2. it ts emphasized that as per the aforementioned instructions, before releasing the final pension and all pensionary benefits to the retiring/retired Govt. servants, the following undertaking may be taken from them:
“if any excess payment is made to an individual then the same shall be recovered from him or her after the disposal of the WP No.9890/2019 pending before the Hon’ble High Court of Dethi or any other similar litigation.”
3. All the Zonal Heads are requested to take immediate necessary action and ensure that the above directions of the Ministry of I&B/CCA, Ministry of I&B, are strictly complied by all the Stations coming under their purview.
