Sub: Amendments in the minimum qualifications for the post of Primary Teachers in Railway schools.
Ref: Railway Board’s letter No. E(P&A)I-2012/PS-5/PE-3(pt) dated 12.04.2022 (RBE No. 50/2022).
Attention is invited to Railway Board’s letter under reference vide which the minimum qualifications for recruitment/promotion of teachers for classes I to VIII were modified in line with National Council for Teachers Education’s (NCTE’s) Gazette Notifications dated 28.06.2018, 13.11.2019 & 13. 10.2021.
2. The Hon’ble Supreme Court vide its judgment dated 11.08.2023 in Devesh Sharma Vs UOI and Ors. has quashed and set aside the NCTE’s notification dated 28.06.2018 prescribing the B.Ed. qualification as one of the qualifications for the post of primary teachers. Accordingly, the candidates with B.Ed. qualifications are not eligible for appointment as a teacher for classes I to V. Further, the Hon’ble Supreme Court vide its subsequent judgment dated 28.08.2024 in Navin Kumar & Ors. Vs UOI & Ors. has upheld the decision of Chhattisgarh High Court quashing the appointments given to the B.Ed. candidates after the judgment dated 11.08.2023.
3. The matter has been examined in Board’s Office and it has been decided to delete the following educational qualifications from the qualifications prescribed for primary teachers of railway schools as per para (I) (1){A) (i) of the annexure to Board’s letter dated 12.04.2022:
“Graduation with at least 50% marks and Bachelor of Education (B.Ed.)
OR
Post-Graduation with minimum 55% marks or equivalent grade and three-year integrated B.Ed.-M. Ed.”
3.1. Further, consequent to deletion of the B.Ed. qualification as one of the qualifications for the post of primary teachers, the following provisions contained in para (II) (3) (a) & (c) of the annexure annexed with Board’s letter dated 12.04.2022 are also deleted:
3. Training to be undergone:- “A person —
(a) who has acquired the qualification of Bachelor of Education from any NCTE recognized institution shall be considered for appointment as a teacher in classes I to V provided the person so appointed as a teacher shall mandatorily undergo a six month Bridge Course in Elementary Education recognized by the NCTE, within two years of such appointment as primary teacher.
(c) who has acquired the qualification of three-year integrated B.Ed.- M.Ed. from any National Council for Teacher Education recognized institution Shall be considered for appointment as a teacher in classes I to V:
Provided that the person so appointed as a teachers shall mandatorily undergo a six-month Bridge Course in Elementary Education recognized by the National Council for Teacher Education, which two years of such appointment as primary teacher.”
3.2. Therefore, post-deletion of the B.Ed. qualification as one of the qualifications for selection of primary teachers, the minimum educational qualifications of primary teachers as prescribed in NCTE’s notifications dated 23.08.2010 and 29.07.2011 (circulated vide Board’s letters No. E(P&A)I-2012/PS-S/PE-3 dt. 09.12.2013 and No. E(P&A)I-2012/PS-5/PE-3 (pt) dt. 12.04.2022) would be as follows:-
Senior Secondary (or its equivalent) with at least 50% marks and 2-year Diploma in Elementary Education (by whatever name known)
OR
Senior Secondary (or its equivalent) with at least 45% marks and 2-year Diploma in Elementary Education (by whatever name known), in accordance with the NCTE (Recognition Norms and Procedure), Regulations, 2002.
OR
Senior Secondary (or its equivalent) with at least 50% marks and 4-year Bachelor of Elementary Education (B.El.Ed.)
OR
Senior Secondary (or its equivalent) with at least 50% marks and 2-year Diploma in Education (Special Education)
OR
Gradation and two year Diploma in Elementary Education (by whatever name known)
AND
Pass in the Teacher Eligibility Test (TET), to be conducted by the appropriate Government in accordance with the Guidelines framed by the NCTE for the purpose.
4. The above orders will take effect from the date of Hon’ble Supreme Court’s judgment i.e. from 11.08.2023.
